I have agreed to act on your behalf in respect of a road traffic or criminal court matter.

I will represent you personally or arrange for appropriate alternative representation at court hearings.

I will keep you advised of significant developments in your case.

I will make appropriate enquiries into the evidence against you and will advise you on this.

I will prepare and conduct the case on your behalf by only carrying out work which I consider to be actually and reasonably necessary and with due regard to economy.

I will only accept instructions from you personally. Instructions may be given orally or in writing.

I will at all times comply with good professional practice and the ethics of the solicitor’s profession.

For the avoidance of any doubt and in accordance with guidance from the Law Society of Scotland, copies of precognitions or statements from witnesses, productions or like documents relating to your case will not be given to you.

Papers in your case will be retained for three years after the conclusion of the proceedings and will then be destroyed.

You undertake:

  1. to give me instructions that allow me to do my work properly
  2. to co-operate with me when asked
  3. to provide any documentation or information promptly when requested
  4. to immediately inform me of any communication or document you receive concerning your case and advise promptly of any change in your circumstances or in your contact details
  5. not to ask me to work in an improper or unreasonable way
  6. not to deliberately mislead me;

If you are applying for legal aid I will rely on the truthfulness of your declarations. When signing a declaration in respect of which eligibility for advice & assistance or legal aid is to be judged it is an offence to make a false declaration. Such a false declaration could make you liable to pay my costs. You must make a full and frank disclosure to me in respect of your income, capital and assets.

If you are granted legal aid I will at all times comply with the ‘Code of Practice for Criminal Legal Assistance’ a copy of which can be found at www.slab.org.uk

Data Protection and Privacy

I will use any data you provide me with in terms of the Data Protection Act 2018 and the General Data Protection Regulations. In short I will use the data you provide me with for the purpose of conducting your case and to allow me to administer my business. I will not be selling or renting your information to others but I may have to share it with relevant regulatory bodies.
